Interpretative and Implementation Framework for the Ibero-American Convention on Access to Justice
From Regional Commitments to People-Centered Justice
The adoption of the Ibero-American Convention on Access to Justice (CIAJ), promoted by the Conference of Ministers of Justice of Ibero-American Countries (COMJIB), represents a milestone for the region and a significant step forward in the global access to justice agenda. As the first legally binding regional instrument of its kind, the Convention establishes a common framework of principles, commitments, and mechanisms to advance more accessible, inclusive, and people-centered justice systems.
The Interpretative and Implementation Framework for the CIAJ was developed as a strategic tool to support this process, promoting a shared understanding of the Convention and facilitating its progressive implementation across different national contexts.
Rather than providing an article-by-article commentary, the Framework offers an integrated interpretation of the Convention’s principles and scope, along with practical guidance to translate its provisions into public policies, institutional reforms, and concrete actions. In doing so, it seeks to bridge the gap between normative commitments and their effective implementation, helping ensure that access to justice translates into tangible improvements in people’s lives.
What Does the Framework Aim to Achieve?
The Framework pursues four main objectives:
- Promote a shared interpretation of the Convention, strengthening understanding of its guiding principles, scope, and contribution to the regional access to justice agenda.
- Guide the design and strengthening of public policies, providing criteria and practical tools to support institutional reforms and justice services that respond to people’s needs.
- Facilitate progressive implementation and adaptation to national contexts, recognizing the diversity of legal systems, institutional capacities, and social realities across Ibero-America.
- Strengthen regional cooperation and peer learning, encouraging the exchange of good practices, technical assistance, capacity development, and the generation of evidence to support and assess progress.
The Framework is intended for governments, judiciaries, prosecution services, public defenders’ offices, civil society organizations, international organizations, and other stakeholders committed to transforming justice systems. It helps translate the Convention’s principles into concrete institutional responses that reduce barriers to accessing justice and address people’s needs and lived experiences.
A Collective Effort to Advance the Regional Access to Justice Agenda
The Framework has been developed in the context of the work of the Ibero-American Alliance for Access to Justice, a regional platform bringing together organizations and institutions committed to advancing people-centered justice.
Its development draws on the knowledge, experiences, and contributions of diverse regional stakeholders, as well as the shared understandings and priorities emerging from regional dialogue and cooperation. It also responds to the need for a practical tool that strengthens the Convention’s technical and legal interpretation, consolidates a shared regional vision, and supports the development of implementation strategies, cooperation, and technical assistance among countries.
This effort is aligned with the global agenda advanced by the Justice Action Coalition, for which Pathfinders for Peaceful, Just and Inclusive Societies serves as Secretariat. It also draws on the standards, approaches, and tools developed by organizations such as the United Nations Development Programme (UNDP), the Organisation for Economic Co-operation and Development (OECD), the World Justice Project (WJP), and the Hague Institute for Innovation of Law (HiiL).
In this way, the Framework seeks to contribute to a regional agenda for people-centered justice, connecting the commitments established in the Convention with the evidence, experiences, and practical tools needed to turn them into reality.
The Ibero-American Alliance’s Commitment to the Convention
Since 2022, the Ibero-American Alliance for Access to Justice has actively supported COMJIB in developing the Convention, contributing to both its technical drafting process and the engagement of diverse stakeholders across the region.
Through its Secretariat, hosted by Pathfinders, the Alliance has promoted civil society participation and provided substantive inputs to strengthen the Convention’s people-centered approach. These contributions include advancing the conceptualization of access to justice and supporting the incorporation of accessibility measures for persons with disabilities and other groups facing heightened barriers to justice.
As part of this commitment, and in the context of the 24th COMJIB Plenary Assembly held in Panama in March 2026, where the Convention text was adopted, the Alliance coordinated a Regional Ibero-American Dialogue on Access to Justice. The event brought together representatives of justice institutions, civil society organizations, legal professionals, researchers, and international experts to foster regional dialogue and support the next stages of the Convention’s signature, ratification, and implementation.
The development of the Interpretative and Implementation Framework builds on this collective effort and reaffirms the Alliance’s commitment to advancing more inclusive, effective, and responsive justice systems that reflect the needs and realities of people across Ibero-America.
